Why Is Online Gambling Illegal In The U.S.?

Though within the U.S. in general, online gambling is illegal there are many states that have legalized it as of 2014 or earlier; with some restrictions in place. For example, 37 states within the U.S. allow their residents to legally gamble online only with casino games that require some level of skill. Casino games that are simply based on luck are still not permitted in most states throughout America.  The three states that do permit online gambling on games that are based on luck are New Jersey, Nevada and Delaware.

As of 2013 U.S. lobbyists are campaigning for the legalization of online gambling in relation to games of chance as opposed to skill. Many small startup Internet gambling companies in the United States are taking advantage of this by providing residents with online casinos where they can play these games. Out of the 50 states that comprise America, 47 of them did not permit their residents to legally gamble on Blackjack and Poker games online as of 2013.

States throughout America have certain tests that they use in order to determine which casino games are based on skill and which ones are based on luck. The way that each state determines if a game is based on skill or luck varies. While some states feel that every game based on any degree of luck is enough to classify that game as “chance-based,” others do not agree. Other states recognize that even casino games based on skill can require a player to have good luck also. There is a predominance test that some states use to classify casino games. In cases where a player with skill can beat a player who is unskilled a minimum of 75% of the time the predominance test says that the games are skill based.

Another type of test states may use to make this determination is called a “material element test.” This test determines how important chance is in a particular casino game. There is another type of testing that is done to reveal if a game where players are forced to bet on how likely they are to be able to win the game is a game of skill or chance. If they have to bet on whether or not they can win it is determined to be a game of skill and if they don’t it is considered to be a game of chance.

As of August 2014the three states that had already legalized online gambling permitted U.S. players to gamble on online Poker. Before the end of 2014 it is expected that online Poker and other types of online gambling will be legalized in California, Texas and Illinois. One possible reason why the three states that have legalized certain types of online gambling have done so is that one out of every four Americans live in one of those three states.
